Terms of Service

1. The agreement

These Terms of Service are a binding agreement between you and Nomad Systems Co ("TourKit"). By creating an account or using tourkitapp.com, you accept them. If you use TourKit on behalf of a brokerage or team, you confirm you have authority to bind that organization.

2. What TourKit does

TourKit generates marketing materials — videos, social images, captions, and flyers — from listing content you provide. Output is generated automatically from your inputs and your brand settings.

3. Your account & team

You're responsible for your login credentials and for activity under your account, including team members you invite. Keep your information accurate. We may suspend accounts that violate these terms.

4. Subscriptions, credits & billing

Paid plans bill monthly through Stripe and renew automatically until canceled. Each plan includes a monthly allowance of listing credits; unused credits do not roll over. A credit is consumed per unique listing address; additional campaigns on the same listing are included. Extra seats bill at the stated per-seat price, prorated. You can cancel anytime via Manage Billing — access continues through the end of the paid period. Except where required by law, payments are non-refundable.

5. Your content & output

You retain ownership of everything you upload (photos, logos, listing details) and of the marketing materials TourKit generates for you. You grant us the limited license needed to store and process your content to provide the service. You're responsible for having the rights to the content you upload (including listing photos and music licensing where applicable for your usage).

6. Professional responsibility

You are the licensed professional. You're responsible for reviewing all generated materials — including AI-written captions — for accuracy and for compliance with MLS rules, advertising regulations, brokerage policies, and fair-housing laws before publishing. TourKit's tools are drafted with fair-housing awareness but do not constitute legal or compliance advice.

7. Acceptable use

Don't misuse the service: no unlawful content, no infringing material, no attempts to break, overload, or reverse-engineer the platform, and no reselling the service without our written agreement.

8. Disclaimers & liability

TourKit is provided "as is" without warranties of any kind. To the fullest extent permitted by law, our total liability for any claim is limited to the amount you paid us in the three months before the claim arose. We are not liable for indirect, incidental, or consequential damages.

9. Changes & termination

We may update these terms or the service; material changes will be posted here with a new date, and continued use means acceptance. You may close your account at any time. These terms are governed by the laws of the State of Indiana, USA.
